Baltimore, MD - Jan. 12, 2024  - A federal appeals court has directed a lower federal court to consider a challenge to Maryland's digital advertising tax on First Amendment grounds, while agreeing to dismiss three other challenges, according to WMAR2News. The law, which taxes companies like Facebook and Google for their digital ad revenue, has faced opposition from Big Tech companies who argue it unfairly targets them. The court disagreed with the lower court's dismissal of the First Amendment challenge and instructed it to assess whether the law violates the First Amendment. The other three challenges were dismissed based on the Tax Injunction Act but can be raised in another legal venue as they were dismissed without prejudice. Maryland Attorney General Anthony Brown continues to defend the law, emphasizing its role in funding education.
