A victory for the 'Wall Heritage Fund': the High Court rejected the petition of the Women of the Wall

Jerusalem, Israel - July 20, 2023 - Today, Israel's Supreme Court outright rejected the tort claim filed by Anat Hoffman and Tami Gottlieb from the group of Women of the Western Wall against the Western Wall Heritage Foundation for damages that supposedly happened to them during a security check at the entrance to the Kotel

In their petition, the women of the Western Wall sought to claim that the fund managers do not have the authority to enforce the High Court ruling prohibiting the introduction of Sifrei Torah to the Kotel, and because of this, the security check was illegal.

However, the judges of the High Court ruled that the ban on bringing Sifrei Torah to the Kotel is in force and within the authority of the security guards and orderlies of the Western Wall to enforce the rules and laws of the place.

In its ruling, the court defined the division of labor: security guards will be responsible for security and ushers will be responsible for the order of the place and the procedures.

The Western Wall Heritage Foundation stated: "The women of the Western Wall filed a personal lawsuit against the Rabbi of the Kotel and the Western Wall Heritage Foundation, a lawsuit that was rejected outright. The court reflected the existing reality in accordance with the High Court's decision, where the security guards enforce security, and the orderlies enforce the procedures."

Keren emphasized their great victory: "The court ruled that the procedure of not bringing in a Sefer Torah is a legal procedure. The women of the Western Wall are turning their failure into their victory. It should be noted that the lawsuit of the women of the Western Wall was filed about three years ago.
