Tamar Etinger, whose husband, Rabbi Achiad Etinger, was killed in the recent terrorist attack in the Ariel Junction, will petition the High Court of Justice – together with the Shomron Regional Council and the Regavim Movement. The joint petition will demand the demolition of the illegal shops from which the terrorist set out on his killing spree. Dagan: "They cut us down in cold blood and no one raises a finger."

The widow of Rabbi Achiad Etinger, Tamar, H'yd, will petition the High Court of Justice, in conjunction with the Shomron Regional Council and the Regavim Movement, against the illegal shops in the Ariel Junction from which the terrorist set out on a murderous rampage that killed 2 Israelis and wounded several others.

The decision to pursue legal remedies took shape after a conversation between Tamar Etinger and Yosi Dagan, the head of the Shomron Regional Council, who came to pay a condolence call at the Etinger home. Tamar asked the obvious question: Why aren't the illegal shops from which the terrorist launched his attack being demolished? Dagan decided to take immediate and decisive action, and turned to Regavim, a non-governmental organization dedicated to combating illegal construction, in order to take the Civil Administration to court.

Regavim's mapping department investigated, and discovered that all of the structures in the junction were built illegally, on state land included in the master-plan for Ariel's access road.  The Civil Administration had, in the past, issued demolition orders - but has never enforced these orders, despite the structures' dangerous proximity to the road.

Tamar Etinger explained why this matter is so important to her: "A situation has been created that allows commerce to be carried out in a very sensitive area, which clearly reduces the level of vigilance of the soldiers on duty there. The same thing happened in the case of Itamar Ben Gal. There is an unnecessarily high level of contact and friction between Arabs and soldiers because of these shops. To make matters worse, the businesses operating in these illegal structures are unlicensed, illegal enterprises. The structures must be demolished without delay."

Yosi Dagan: "Again and again, we see illegal construction by Arabs, not only in Area B but in Area C as well, particularly in close proximity to Jewish communities. This is part of the attempt by the local Arab population to seize and control the territory. We will use all means at our disposal to put a stop to the illegal construction, the seizure of our land, and the chaos that has cost too many Jewish lives."
