Marilyn Mosby's Public Defenders May Renew Request To Move Federal Trial Out Of Baltimore, Says Court Filing

Baltimore, MD - June 26, 2023 -  A filing in federal court on Friday revealed that public defenders for former Baltimore City State's Attorney Marilyn Mosby might again ask for a change of venue.

The indication comes from a request by both the prosecution and defense attorneys to change the schedule of pretrial deadlines.

In the filing, U.S. Attorney for Maryland Erek Barron said, "The defense has advised that it may make a potential expert disclosure in support of a motion to change venue to be filed on July 30, 2023."

Because of the potential venue change request, attorneys on both sides are asking the court to add 30 days to some pre-trial deadlines.

In January, the court denied a request from Mosby's defense team to move the trial to Greenbelt. Her attorneys, at the time led by A. Scott Boldenclaimed there was "public animus" due to media coverage of the trial.

Mosby was indicted in January 2022. She is accused of perjury and making false mortgage applications relating to the purchases of two vacation homes in Florida. Mosby has maintained her innocence.

Mosby's attorneys say she did not know about the tax lien in Baltimore that led to the accusations of Mosby falsifying court documents. Baltimore City Council President Nick Mosby, Marilyn's husband, handled the couple's finances, according to Marilyn Mosby.

Marilyn Mosby is also accused of perjury when she claimed COVID hardship when accessing $80,000 in retirement funds. City employees are not normally permitted withdrawals even with a penalty. Prosecutors say that Mosby used that money to put a down payment on an eight-bedroom home near Orlando, Fla., prosecutors said.
