Baltimore, MD - Dec. 14, 2017 - The cold weather is upon us. Along with this comes increased risk for auto theft due to the desire to warm cars up before getting in. This morning a Toyota Sienna was stolen from the 3900 Block of Pinkney Rd. It is clear on the surveillance video what occurred. The victim started the car using the push button ignition. The video shows 2 black males walking past the home and coming back a few minutes later and stealing the vehicle.

This time of year always sees an uptick in these “puffer” thefts. Law enforcement refers to them as puffer thefts because of the puffs of exhaust vapor that come from a car sitting in the driveway in cold weather.

It is important to be aware that in addition to making you a target for theft, you may be exposing yourself to additional financial and legal problems.

* You May Receive a Ticket

As we found out in today’s incident, police are required to give a $70 citation for leaving the car running when a car is stolen under these circumstances. In order for the officer to put the information out to be on the look out for the car, they must issue the citation.

Maryland Transportation Section § 21-1101. (a) Except as provided in subsection (c) of this section, a person driving or otherwise in charge of a motor vehicle may not leave it unattended until the engine is stopped, the ignition locked, the key removed, and the brake effectively set.

* Your Insurance Company May Try to Deny the Claim

Violation of the above code may also be used by your insurance company to deny your claim for theft.
 Some insurers will deny a claim if you have displayed negligence in the course of the incident, and leaving your keys in your car could count as negligence.
 An insurer trying to prove negligence can turn to local laws and/or ordinances such as the one above. If an insurer is trying to prove that you didn’t take reasonable care in preventing the car theft, having such a violation/ticket on your record could help your carrier’s case that the stolen car doesn’t warrant compensation because you weren’t heeding the law.

* Other Liability

If the stolen vehicle is used in the commission of a crime or in an accident the same ordinance might be used to try to extend liability to the owner of the car.

* Follow the Following Tips to Avoid These Situations

• Don’t start your car and leave unlocked.

• Don’t leave your keys in the car and avoid leaving valuables in plain sight

• Consider purchasing a remote starter or similar device that allows a car to run without the use of a key.

** It should be noted that the remote start will help prevent your car from being stolen but won’t necessarily help avoid the citation for leaving engine running on a vehicle. These citations can be issued whether the car is stolen or not.
